Kentucky's new broad form deed law - is it constitutional
摘要
A review of the legislative history and the constitutional challenges of the Kentucky House Bill 32 (HB 32) finds it to be suspect in several areas. Case law shows a pattern of controversy over whether a mineral owner may surface mine property, particularly when the mining rights derive from the broad form deed type of severance deed. The extent to which the Kentucky Supreme Court adheres to prior interpretations of broad form deeds will determine whether it upholds the constitutionality of HB 32. If the courts are seeking a way to change its attitude toward broad form deeds, HB 32 may provide the opportunity.
