Research on the Expansion of the Deliberation Function of the Administrative Reconsideration Committee under the New Administrative Reconsideration Law
摘要
我国行政复议委员会的试点工作已经进行了十多年，但对于行政复议委员会在功能定位上属于咨询机构还是审议机构一直存在争议。新《行政复议法》以法律形式正式确定了行政复议委员会制度，但是咨询型功能定位无法契合新《行政复议法》第一条主渠道目标的价值追求，无法应对复议管辖体制改革带来的新挑战。因此，应当立足于行政复议委员会制度改革实践，锚定行政复议委员会拓展审议功能的改革进路。就具体完善方案而言，新《行政复议法》应进一步修法增设行政复议委员会的审议功能，细化促进其审议功能实现的复议委员会设置，并基于审议功能实现需求优化行政复议委员会运行程序。
