我国到底有多少部现行有效法律―兼论“准法律决定”的合宪性完善
摘要
Catalogue for Laws in Force of People's Republic of China appended to White Papers of China's Legal System Construction and the Standing Committee of National People's Congress give different statements on the numbers of laws in force in China now. Such substantially different statements are possible for the fact that there exist ”quasi-law decisions”. Formal rationality standard and substantive rationality standard of different times are used to define ”law” in constitutional sense. Among 239 laws in force in China now, 23 laws don't have ”law” as the last word in their titles. ”Quasi-law Decisions” conform to the constitution and are justifiable to some extent, but still three measures can be taken to improve their constitutionality.
