Foucault held that fundamental factors that influence and control the movement of discourse is power. Those who hold power enjoy the rights of speech. On the contrary, those who do not have discourse power do not enjoy the rights of speech. The unsettled law ease described by Margaret Atwood in Alisas Grace is the result of discourse power game.
